Article 1 – LEGAL NOTICES

The Site is hosted by the company WebMarketing Services, located at 435 Allée Françoise Aubrun; 13100 le Tholonet.
Article 2 – GENERAL PROVISIONS RELATING TO THESE GENERAL CONDITIONS
The general conditions of sale are applicable exclusively to the online sale of products offered by White Mango on the Website.
The General Terms and Conditions are made available to customers on the Site where they can be directly consulted and can also be communicated to them on simple request by any means.
The General Conditions of Sale are enforceable against the customer who acknowledges, by checking a box or clicking ON the button provided for this purpose, having been aware of them and having accepted them before placing an order. Validation of the order by its confirmation constitutes acceptance by the buyer of the General Terms and Conditions in force on the day of the order, the conservation and reproduction of which is ensured by White Mango
Article 3 – PRODUCT DESCRIPTION
The Site is an online sales site for the sale of furniture, objects and art open to any natural or legal person using the White Mango Site.
The Products presented on the Site are each subject to a description mentioning their essential characteristics. These products and services are offered while stocks last. The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to the colors. The instructions for use of the Product, if it is an essential element, appear on the Site or are, at the latest, part of delivery. The Products comply with the requirements of current French law.
Each product is accompanied by a precise description established and provided by WHITE MANGO, the manufacturer, or the importer. White Mango is in no way responsible for incorrect data transmitted by manufacturers.
Confirmation of technical details is possible by calling White Mango customer service or contacting them via the contact form.
Article 4 – CREATION OF THE CUSTOMER AREA
To place an order on the Site, the Customer must first create their personal customer area. Once created, to access it, the Customer must identify themselves using their username and secret, personal and confidential password. It is the Customer's responsibility not to communicate his username and password in accordance with the provisions of the PERSONAL DATA article of these General Conditions. Each Customer undertakes to maintain strict confidentiality regarding the data, in particular username and password, allowing him to access his customer area, the Customer acknowledging that he is the only one responsible for access to the Service through his username and password, unless fraud is proven. Each Customer further undertakes to immediately inform White Mango in the event of loss, misappropriation or fraudulent use of their username and/or password.
After creating their personal customer area, the Customer will receive an email confirming the creation of their customer area.
The Customer undertakes when registering to:
• Provide real, accurate, up-to-date information at the time of entry into the service registration form, and in particular not use false names or addresses, or names or addresses without authorization.
• Keep registration data up to date to ensure that it is real, accurate and up to date at all times.
The Client further undertakes not to make available or distribute illicit or objectionable information (such as defamatory information or information constituting identity theft) or even harmful information (such as viruses). Otherwise, White Mango will be able to suspend or terminate the Customer's access to the Site at its sole discretion.
Article 5 – ORDERS
The Buyer, who wishes to order a product or service via the WHITE MANGO website, must:
– complete the identification form on which you will indicate all the contact details
– complete the online order form, specifying all the references of the products or services chosen
– validate your order after a complete check
– make payment under the conditions provided
– confirm your order and payment.
Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of the right to rely on one's own conditions of purchase or other conditions.
All the data provided and the recorded confirmation will constitute proof of the transaction.
Confirmation will be worth signing and acceptance of transactions.
The seller will communicate by e-mail confirmation of the registered order.
WHITE MANGO is not responsible for email sending errors, nor for package sending errors due to an incorrectly completed form.
Any order constitutes acceptance of the price and description of the product by the buyer. In the event of dissatisfaction with the product, he has a right of withdrawal (see corresponding article of these General Terms and Conditions).
WHITE MANGO reserves the right to refuse to validate an order in the event of a pending dispute and undertakes to inform the customer.
The order will be shipped within the timeframe specified on the product sheet.
After ordering, an invoice will then be sent by email to the customer.
The customer is aware that his order involves payment for the selected items as well as shipping costs in order to definitively validate it.
No address changes can be made after the order has been shipped. All costs incurred by the carrier and White Mango (failed delivery, storage, return, re-delivery, etc.) in the event of an incorrect delivery address given by the customer when ordering, will be the responsibility of the customer. Thus, White Mango cannot be held responsible in any way in the event that an error when placing the order prevents or delays delivery/delivery.
WHITE MANGO strives to guarantee optimal availability of its Products. Product offers are valid while stocks last.
If, despite WHITE MANGO's best efforts, a Product proves to be unavailable after the Customer's order, WHITE MANGO will inform the Customer by email as soon as possible and the Customer will have the choice between:
• delivery of a Product of a quality and price equivalent to that initially ordered, or
• reimbursement of the price of the Product ordered no later than thirty (30) days from payment of sums already paid.
It is agreed that apart from the reimbursement of the price of the unavailable Product, if this option is requested by the Customer, White Mango is not liable for any cancellation compensation, unless the non-performance of the contract is personally attributable to it.
With the exception of any contrary notice appearing in these General Conditions and without prejudice to the right of withdrawal provided for by applicable law, the Customer's orders are firm and final.
White Mango archives Product sales contracts in accordance with applicable legislation. By making a request to the following address contact@white-mango.fr White Mango will provide the Customer with a copy of the contract subject to the request.
Any order modification by the Customer after confirmation of his order is subject to the agreement of White Mango.
The Customer undertakes to read the General Conditions of Sale then in force before accepting them and confirming the terms and possible delivery and withdrawal costs prior to payment of his order. Confirmation of the order entails acceptance of the General Terms and Conditions and forms the contract.
Article 6 – PAYMENT TERMS AND SECURITY
The Customer expressly acknowledges that any order placed on the Site is an order with payment obligation, which requires the payment of a price in exchange for the supply of the Product ordered.
In any case, White Mango reserves the right to check the validity of the payment, before shipping the order, by all necessary means.
White Mango uses the PayPlug online payment solution, the secure SystemPay system offered by Banque Populaire, and using 3Dsecure and the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party cannot become aware of it during transport on the network. The information to be provided by the customer is the card number, its expiration date, and the last three digits appearing on the back of the card.
Orders can be paid using one of the following payment methods:
- Payment by credit card. Payment is made directly on the secure banking servers of the White Mango bank; the Customer's bank details do not pass through the Site. The bank details communicated during payment are protected by an SSL (Secure Socket Layer) encryption process. In this way, these contact details are not accessible to third parties.
We accept Cartes Bleues, Mastercard, Eurocard and Visa.
Payment in several installments (X3 and X4) is eligible for baskets ranging from €100 to €3,000 maximum.
The Customer's order is recorded and validated upon acceptance of payment by the bank.
The Customer's account will be debited for the corresponding amount only when the details of the bank card used have been verified and the debit has been accepted by the bank that issued the bank card.
The inability to debit the sums due will result in the immediate nullity of the sale.
The bank card may in particular be refused if it has expired, if it has reached the maximum spending amount to which the Customer is entitled or if the data entered is incorrect.
– Payment by PAYPAL electronic wallet. The Customer already has an account on the electronic wallet used by White Mango. The Customer can use this account and pay for their order in complete security without providing their bank details.
– By check: the customer can send a check to the address indicated when ordering, we will dispatch the equipment upon receipt of the check plus a period of 10 days (validation of payment by the bank).
- Payment by bank transfer. The Customer can pay for their order by bank transfer. When ordering, White Mango will communicate the details of the account to which to make the transfer, as well as the order reference to be indicated in the transfer order. Orders are processed within 48 hours maximum following receipt of the transfer.
Where applicable, the order validated by the Customer will only be considered effective when the secure banking payment center has given its agreement to the transaction.
As part of the control procedures, White Mango may have to ask the Customer for all the documents necessary to finalize their order. These parts will not be used for any purpose other than these.
Article 7 – PAYMENT OF THE PRICE
The prices appearing on the WHITE MANGO website are inclusive of VAT in euros, VAT will be applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.
WHITE MANGO reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the website on the day of the order will be the only one applicable to the buyer.
The prices indicated include processing and order preparation costs. Participation in transport and delivery costs is automatically added during order validation according to the formula chosen by the Buyer (except for countries outside France).
The price is due when ordering.
The prices displayed on the products are indicated All Taxes Included (TTC) with a VAT of 20%, and excluding shipping costs.
All orders are payable in euros.
Article 8 – FORMATION OF THE CONTRACT
The contract between White Mango and the Customer is formed when the Customer sends the confirmation of his order.
The Customer's attention is particularly drawn to the method of acceptance of the order placed on the Site. When the Customer places his order he must confirm it by the “double-click” technique, that is to say that after having selected Products added to the basket, the Customer must check and possibly correct the content of his basket (identification, quantity of products selected, price, terms and delivery costs) before validating it by clicking on “I validate my delivery”, then he acknowledges accepting these T&Cs before clicking on the “I pay” button, finally he validates his order after having filled in his bank details. The “double click” constitutes an electronic signature and is equivalent to a handwritten signature. It constitutes irrevocable and unreserved acceptance of the order by the Customer.
The archiving of communications, purchase orders and invoices is ensured by White Mango on a reliable and durable medium so as to constitute a faithful and durable copy. These communications, purchase orders and invoices may be produced as proof of the contract. Unless proven otherwise, the data recorded by White Mango on the internet or by telephone constitutes proof of all transactions between White Mango and its Customers.
The order can be resolved by the Customer by registered letter with acknowledgment of receipt or by writing to the following email: contact@white-mango.fr in the event of:
• delivery of a Product that does not conform to the declared characteristics of the Product;
• delivery exceeding the deadline set in the order form or, in the absence of such a date, within thirty (30) days following the conclusion of the contract, after White Mango has been ordered, according to the same terms and without result, to make delivery within a reasonable additional time;
• an increase in price which is not justified by a technical modification of the product imposed by the public authorities.
In all these cases, the Customer may demand reimbursement of the deposit paid plus interest calculated at the legal rate from the date of receipt of the deposit.
The order can be resolved by White Mango in the event:
• refusal of the buyer to take delivery;
• non-payment of the price (or the balance of the price) at the time of delivery.
The Operator remains the exclusive owner of the Products ordered on the Site until payment of the full price, including any shipping costs.
Article 9 – PRODUCT AVAILABILITY
All delivery times indicated by WHITE MANGO are working days, they do not include weekends and public holidays.
The delivery dates indicated on each product sheet are average delivery times and are therefore only indicative. These dates and deadlines cannot under any circumstances bind WHITE MANGO to the customer. Indeed, many factors which may be beyond the control of WHITE MANGO are taken into account such as: the delivery destination, the nature of the product (volume, quantity, weight), the carrier associated with the order, unforeseen transport, delays carrier traction, strikes, weather, overload of activity, appointment date chosen by the customer, etc.).

WHITE MANGO undertakes to ship one or more products in stock 48 working hours after your order (excluding comfort delivery or necessary workshop service). This deadline is only valid:
– for products in stock marked “shipped within 48 hours”
– for any order placed and paid during the week (from Monday 9 a.m. to Friday 9 a.m.) subject to payment validation. Orders placed and paid from Friday 9 a.m. to Monday 9 a.m. will be considered valid on Monday morning.
Any order placed and paid for on a public holiday will be considered valid on the following working day.
Article 10 – SHIPPING AND DELIVERY
Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area. A buyer's order may be delivered in several packages in certain rare cases.
The customer must check the condition of the package and products before signing the delivery note. In the event of damage during transport, please follow the instructions sent during shipping. White Mango must always be notified of damage during transport, by the Buyer in parallel with the carrier.
If delivery times exceed thirty days from the order (excluding delivery including home installation or delivery abroad), the sales contract may be terminated and the buyer reimbursed. In addition, all deadlines indicated by White Mango are working days, they do not include weekends and days
In the event of a lost package, White Mango will carry out an investigation with the carrier.
The customer must also ensure that the carrier's truck can access the delivery location either by semi-trailer, by carrier or small carrier (minimum 19 tonnes) and not only by light vehicle. In the absence of access in 19t, an additional cost for delivery by light vehicle may be invoiced to the customer upon quote.
Delivery or collection of the package and time:
If the customer is absent during the scheduled appointment with the carrier, any re-delivery will be his responsibility.
If the customer wishes, or cannot make himself available to receive his package, he will have to pick it up at the nearest carrier agency, otherwise the package will be returned to White Mango.
If the customer does not respond to the carrier's requests to make an appointment, the package will be returned to White Mango within 7 days. For a reshipment, the customer must pay the full and actual transport price (twice the contribution requested when ordering.)
For the delivery of their package, the customer must be available and allow a reception time slot of up to one day (from 9 a.m. to 5 p.m. maximum depending on the carrier). For delivery on Saturday, or for a shortened time slot, the customer will have to pay a supplement if this option is offered by the delivery agency.
Delivery methods: - Standard delivery (at the foot of the truck): The products are delivered on a pallet, in packages or in specialized packaging. They are left by the delivery person at the foot of the truck (or at the bottom of the building or in front of the gate if possible). This standard delivery is made by appointment, the carrier will contact you a few days after shipment by e-mail, SMS or telephone. In all cases, even for large orders, unpacking and transport from the truck to the arrival room of the furniture or object must be assumed by the customer. The same goes for the processing of pallets and packaging. The customer must ensure access of the truck to its delivery location and will be responsible for this.
NB: As unpacking is not included in this service, the customer must check the condition of the package AND the products before signing
of the delivery note (see “receipt precautions” below).
– Collection in store: this delivery method is done by you in our warehouse in CAVAILLON (84). Provide a means of transport suitable for the products ordered (car, truck, van, etc.). Collection is by appointment only during opening hours indicated on the site.
– Light parcels by courier (less than 30 kg): Delivery by traditional light parcel carrier. The carrier may not contact you in advance to schedule an appointment. He will leave you a notice in your mailbox if you are absent, as well as all the instructions for collecting your package from the agency or for rescheduling a delivery person's visit.
Transport cost: Delivery in mainland France is free. Restrictions apply to certain products classified as exceptional pieces on the site, the weight and size of which are subject to request for quote and a contribution from the customer to the delivery costs.
In certain cases, costs for the second presentation at the customer's home may be invoiced directly to the customer by the carrier or White Mango if the customer is not at home on the scheduled delivery day, or if the access information is false ones requiring redelivery.
Packaging: The products are delivered in the packaging best suited to their proper delivery (pallet, boxes, bubble wrap, plastic film, etc.). These are made to measure by our teams. It is also possible, for the sake of efficiency and optimization of transport, that we hand over certain furniture under cover to the specialized carrier, ensuring the best quality of transport and requiring maximum precautions taken by the delivery people.
Receiving Precautions: Simple and clear receiving instructions will be sent to you once the order has been shipped. This is advice to help the customer in a possible dispute between the latter and the carrier. Under no circumstances does White Mango assume responsibility for this advice.
The items are checked by the White Mango logistics teams and by the carrier before shipment and are therefore deemed to be in good condition once picked up by the carrier. However, damage to the packaging or the product may occur during transport. In the event that liability of the carrier is refused by the latter, no recourse can be made to White Mango.
Upon receipt, the customer has the responsibility and obligation to check the condition of the products in the presence of the carrier AND before signing the delivery note.
White Mango strongly advises its customers to check the condition and conformity of the goods before signing the delivery note and in the presence of the delivery person even if the packaging appears to be in good condition.
The delivery person is obliged to wait until you have checked the goods. If, however, he does not want to wait, this must be clearly mentioned on the delivery note.
Before unpacking, if there is anything in the package, the customer must write it clearly on the delivery note (“Packaging with holes, tears, crushed, opened, etc.”).
After unpacking, if the customer notices a defect in the product, he will expressly mention it in handwritten and detailed form on the delivery slip (“item broken, split, damaged, having suffered an impact”). Please note, the words “subject to unpacking” are not valid.
This approach is valid for all orders regardless of the type of product, the number of packages, the packaging or the type of delivery chosen.
Count and mention on the delivery note if a package is missing.
Ask for a duplicate delivery note.
The information valid for writing on the delivery note is ONLY the following: "item broken, split, damaged, having suffered an impact,..." or "packaging with holes, torn, crushed, opened,...".
In the absence of this step, the products are deemed to be compliant and no complaint from the customer against the carrier or White Mango can be upheld on this point subsequently. In the event of a problem, the customer cannot under any circumstances declare that he was not kept informed of the procedures to follow in the event of a dispute linked to transport. In the event that liability of the carrier is refused by the latter, no recourse can be made to White Mango.
Exceeding the delivery time: White Mango undertakes to do everything possible to meet deadlines. However, it may nevertheless happen that the supply is delayed independently of our wishes and therefore results in a delay in delivery for the customer. In application of article L 138-2 of the Consumer Code: “In the event of failure by the professional to fulfill his obligation to deliver the good or provide the service on the date or at the expiration of the period provided for in the first paragraph of article L. 138-1 or, failing that, at the latest thirty days after the conclusion of the contract, the consumer may terminate the contract, by registered letter with acknowledgment of receipt or by writing on another durable medium , if, after having ordered, according to the same terms, the professional to make the delivery or to provide the service within a reasonable additional period, the latter has not carried out within this period. The contract is considered terminated upon receipt by the professional of the letter or writing informing him of this resolution, unless the professional has complied in the meantime. However, the consumer may immediately terminate the contract when the professional refuses to deliver the goods or provide the service or when he does not fulfill his obligation to deliver the goods or provide the service on the date or expiry of the contract. period provided for in the first paragraph of the same article L. 138-1 and that this date or this period constitutes for the consumer an essential condition of the contract. This essential condition results from the circumstances surrounding the conclusion of the contract or from an express request from the consumer before the conclusion of the contract. »
For delivery in France or collection in store by a Swiss buyer, the sale is made inclusive of tax. The customer can then request a VAT refund from White Mango (PABLO procedure). It will be refunded once the import into Switzerland and clearance through customs has been completed.
The online sale of WHITE MANGO products is intended mainly for customers residing in mainland France.
However, other French territories including Corsica, Switzerland and other EU countries and their residents can be delivered, but must contact us before finalizing your order.
Article 11 – RIGHT OF WITHDRAWAL
If a delivered Product does not give complete satisfaction to the Customer, the latter may return it to White Mango. The Customer will have fourteen (14) days to do so from the date of receipt of the order.
In accordance with article L.221-21 of the Consumer Code and in order to implement this right of withdrawal under the conditions of articles L. 221-18 et seq. of the Consumer Code, the Customer is invited to complete the standard withdrawal form by clicking on the link below found on the White Mango website.
White Mango will send an acknowledgment of receipt of the Customer's withdrawal request by e-mail.
Return costs are the responsibility of the Customer and the product must be returned in its original packaging, in perfect condition, suitable for resale, unused and with all possible accessories.
In addition to the returned Product, the return package must also contain a letter specifying the exact and complete contact details (surname, first name, address) of the Customer as well as the order number, and the original purchase invoice.
White Mango will reimburse the Customer for the amount of the Product within fourteen (14) days from receipt of the Product and all the elements enabling the Customer to be reimbursed. This reimbursement may be made by the same means of payment as that used for the Customer.
Cancellation before shipment:
The customer can, if he wishes, cancel his order entirely or partially before shipping his products from us. In this case White Mango will reimburse the customer. However, management and file processing fees will be requested from the buyer. They will then be deducted from the reimbursement, made within 14 days. The costs amount to 20% of the amount of the order excluding delivery costs. In the case of a split delivery, the cancellation cannot relate to products already delivered unless the right of withdrawal can still be requested by the customer. If the customer wishes to cancel part of their order, White Mango will retain the 20% management and file processing fees on the canceled products. Under no circumstances will it be possible to reverse the delivery costs invoiced.
Cancellation after shipment:
The customer will not be able to request the cancellation of his order if the goods have been taken care of by the carrier. The customer must use his right of withdrawal after delivery (see article 11).
NB 1: A refusal to receive an order from the customer, on the day of delivery, for compliant products without valid reason for transport breakage or defect is assimilated to a cancellation after shipment (see above).
NB 2: If the customer wishes to cancel his order even though he has received the goods, he must then exercise his right of withdrawal (see article 11).
Furthermore, White Mango reserves the right to cancel any order that cannot be completed due to economic or technical reasons affecting the manufacturing process. Cancellation of an order commits White Mango to fully reimburse the sums paid for this order, without the customer being able to claim additional compensation.
By accepting these General Conditions of Sale, the Customer expressly acknowledges having been informed of the withdrawal procedures.
Article 12 – CUSTOMER SERVICE
The Customer can contact White Mango
– at the following number 06 76 95 02 83 on the following day and opening hours Monday to Friday from 9 a.m. to 12 p.m. and 2 to 5 p.m.
– by email to contact@white-mango.fr indicating their name, telephone number, the subject of their request and the number of the order concerned.
Article 13 – INTELLECTUAL PROPERTY AND LICENSE TO USE THE SITE
White Mango is the sole owner of all elements present on the Site, in particular and without limitation, all texts, files, animated or non-animated images, photographs, videos, logos, designs, models, software, brands, visual identity, database, structure of the Site and all other intellectual property elements and other data or information (hereinafter, the “Elements”) which are protected by French and international laws and regulations relating in particular to intellectual property.
Consequently, none of the Elements of the Site may in whole or part be modified, reproduced, copied, duplicated, sold, resold, transmitted, published, communicated, distributed, broadcast, represented, stored, used, rented or exploited in any other way. , free of charge or for a fee, by a Customer or by a third party, whatever the means and/or supports used, whether known or unknown to date, without the express prior written authorization of White Mango on a case-by-case basis, and the Customer is solely responsible for any unauthorized use and/or exploitation.
White Mango reserves the right to take legal action against persons who have not complied with the prohibitions contained in this article.
ARTICLE 14 – LIABILITY AND GUARANTEE
White Mango cannot be held responsible for non-performance of the contract due to the Customer or due to an event qualified as force majeure by the competent courts or even due to the unforeseeable and insurmountable act of any third party herein.
The Customer acknowledges that the characteristics and constraints of the Internet do not guarantee the security, availability and integrity of data transmissions over the Internet. Thus, White Mango does not guarantee that the Site and its services will operate without interruption or operating error. In particular, their use may be temporarily interrupted due to maintenance, updates or technical improvements, or to change their content and/or their presentation.
White Mango cannot be held responsible for any use made of the Site and its services by Customers in violation of these General Conditions and for any direct or indirect damage that this use could cause to a Customer or a third party. In particular, White Mango cannot be held responsible for false statements made by a Customer and for their behavior towards third parties. In the event that the liability of the Operator is sought due to such behavior of one of its Clients, the latter undertakes to guarantee White Mango against any conviction pronounced against it as well as to reimburse White Mango all costs, including attorneys' fees, incurred for his defense.
Independently of any additional contractual guarantee (commercial guarantee) which may be granted, the Products benefit from the legal guarantee of conformity provided for in articles L. 217-4 et seq. of the Consumer Code (in particular L. 217-4 to L. 217 -14 of the Consumer Code), and the guarantee against hidden defects provided for in articles 1641 to 1649 of the Civil Code.
When you act within the framework of the legal guarantee of conformity:
• you benefit from a period of two (2) years from delivery of the goods to act:
• you can choose between repairing or replacing the goods, subject to the cost conditions provided for by article L. 217-9 of the Consumer Code;
• you are exempt from providing proof of the existence of the lack of conformity of the goods during the twenty-four (24) months following delivery of the goods (except second-hand or reconditioned goods).
You can decide to implement the guarantee against hidden defects in the item sold within the meaning of article 1641 of the Civil Code. In this case, you can choose between canceling the sale or reducing the sale price in accordance with article 1644 of the Civil Code.
Reproduction of articles L. 217-4, L. 217-5, L. 217-7, L. 217-9 and L. 217-12 of the Consumer Code, article 1641, 1644 and the first paragraph of article 1648 of the Civil Code, as in force on the date of these General Conditions of Sale:
Art. L.217-4 of the Consumer Code:
“The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility. »
Art. L.217-5 of the Consumer Code:
“The property complies with the contract:
1° If it is suitable for the use usually expected of similar goods and, where applicable:
– if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
– if it presents the qualities that a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling;
2° Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted. »
Art. L.217-7 of the Consumer Code:
“Defects of conformity which appear within a period of twenty-four months from delivery of the goods are presumed to exist at the time of delivery, unless proven otherwise.
For goods sold second-hand, this period is set at six months.
The seller can combat this presumption if it is not compatible with the nature of the goods or the alleged lack of conformity. »
Art. L.217-9 of the Consumer Code:
“In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods. However, the seller may not proceed according to the buyer's choice if this choice results in a cost that is manifestly disproportionate with regard to the other method, taking into account the value of the goods or the importance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer.
Art. L.217-12 of the Consumer Code:
“The action resulting from the lack of conformity is prescribed two years from the delivery of the goods. »
Art. 1641 of the civil code:
“The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer would not have acquired it, or He would have given only a lower price if he had known about them. »
Art. 1644 of the civil code:
“In the case of articles 1641 and 1643, the buyer has the choice of returning the thing and having the price refunded, or keeping the thing and having part of the price refunded. »
Art. 1648 paragraph 1 of the civil code:
“The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. »
Please note that the search for amicable solutions prior to possible legal action does not interrupt the time limits for legal guarantees or the duration of any possible contractual guarantee.

Furthermore, the Customer acknowledges that White Mango cannot endorse, guarantee or take over all or part of the conditions of use and/or the content of these third-party sites.

White Mango invites the Customer to notify it of any hypertext link present on the Site which would allow access to a third-party site offering content contrary to the laws and/or good morals.
The Customer may not use and/or insert a hyperlink pointing to the site without the prior written consent of White Mango on a case-by-case basis.
ARTICLE 17 – REFERENCES
The Client authorizes White Mango to mention the Client's name and its logo as a reference in its communication media (brochure, website, commercial proposal, relations with the press, press release, press kit, internal communication, etc. ).
ARTICLE 18 – GENERAL PROVISIONS ENTIRE AGREEMENT OF THE PARTIES
These General Conditions constitute a contract governing the relationship between the Customer and White Mango. They constitute the entire rights and obligations of the Company and White Mango relating to their subject matter. If one or more stipulations of these General Conditions are declared null in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain their full force and scope. Furthermore, the fact for one of the parties to these General Conditions not to take advantage of a failure by the other party to any of the provisions of these General Conditions cannot be interpreted as a waiver on its part of avail themselves of such a breach in the future.
CHANGES TO TERMS
White Mango reserves the right to modify at any time and without notice the content of the Site or the services available there, and/or to temporarily or permanently cease operating all or part of the Site.
In addition, White Mango reserves the right to modify at any time and without notice the location of the Site on the Internet, as well as these General Conditions. The Customer is therefore required to refer to these General Conditions before using the Site.
The Customer acknowledges that White Mango cannot be held responsible in any way towards him or any third party as a result of these modifications, suspensions or cessations.
White Mango advises the Customer to save and/or print these General Conditions for safe and lasting storage, and thus be able to invoke them at any time during the execution of the contract if necessary.
COMPLAINT – MEDIATION

In the event of failure of the complaint request to customer service or in the absence of a response from this service within ten (10) days, the Customer may submit the dispute relating to the purchase order or these General Terms and Conditions l opponent to White Mango of a mediator.

These General Conditions are governed, interpreted and applied in accordance with French law. White Mango reserves the right to modify the General Terms and Conditions.
ACCEPTANCE OF THE GENERAL CONDITIONS BY THE CUSTOMER
The Customer acknowledges having read these General Conditions carefully.
By registering on the Site, the Customer confirms having read the General Conditions and accept them, making him contractually bound by the terms of these General Conditions.
The General Conditions applicable to the Customer are those available on the date of the order, a copy dated to date of which can be given to the Customer upon request, it is therefore specified that any modification of the General Conditions which is made by White Mango will not be will not apply to any order placed previously, unless expressly agreed by the Customer at the origin of a given order.
